Life wins: What the Supreme Court’s Reversal of Roe v. Wade Means
Here are some ways to counter the false arguments of the pro-abortion crowd
U.S. Rep. Jim Jordan (R-Ohio) summed up Friday’s Supreme Court decision the best with just two words: “Life wins.”
That’s how many tens of millions Americans felt after the Supreme Court announced that it was overturning the 50-year-old ruling known as Roe v. Wade that unconstitutionally took away state’s rights to rule on the issue of abortion.
But with the way various politicians and the news media are reporting on it, there is likely some confusion about what Friday’s ruling actually means. You may face some arguments from people on the left making false claims so here are some good counterpoints.
The 1973 Supreme Court ruling did not make abortion a constitutional right. The Supreme Court does not have the power to alter the Constitution, either to add to or subtract from it. It also didn’t make abortion legal, per se. The Roe v. Wade ruling simply disallowed the 50 states to prohibit abortion, which in practice made abortion legal without an actual law saying it was. But just because something is legal doesn’t make it a right.
The 10th Amendment to the Constitution makes it illegal for the Federal government to overrule the states in making laws or prohibiting them. That amendment says that any rights not specifically granted to the Federal government in the Constitution belong to the states. Abortion – and health care more generally – is not listed as a duty of the Federal government, which means it is up to each state to decide how to handle it.
Friday’s ruling does not make abortion illegal. It follows that since the Federal government doesn’t have the right to make abortion legal, it also doesn’t have the right to make it illegal. Constitutionally, the legality of abortion is left up to each state. Obviously, some states will work to place very strict rules on it while others will leave it wide open. So people will still be able to murder unborn children in some states.
The pro-life movement is primarily a movement of women. The left has tried to paint the pro-lifers as pervy old men who just want to keep women pregnant and chained up at home. But look at any pro-life rally and you’ll see the majority of participants are women – often an overwhelming majority. One victory march on Friday that I saw on video featured almost all women, many of them in their 20s and 30s.
Limiting abortion or severely restricting it is not a form of racism. In fact, it is the opposite, since black babies make up a disproportionate number of those aborted. It is estimated that since the beginning of Roe v. Wade that as many black babies were killed as were born. The vast majority of abortion clinics are located in inner city black neighborhoods. It makes one wonder if this is the reason why Democrats – the party of slavery, segregation and the Ku Klux Klan – are so adamant in their support of abortion.
Abortion is not health care. Although the pro-abortionists have tried to lessen the severity of abortion by couching it in language about “women’s health care,” that is not remotely the case. Women can receive health care in order to have a healthy pregnancy and to ensure the well-being of the child in the womb. But killing the baby in the womb – either by poisoning it or tearing it apart – is not health care for either the mother or the child.
“My body, my choice” doesn’t apply since the baby is not part of the woman’s body. Yes, the baby is attached to the woman and relies on the woman for survival until birth, but the baby has separate DNA. It has half of the mother’s chromosomes and half of the father’s, making a unique combination. Anything that is a part of the woman has 100 percent of her DNA.
This Supreme Court is not illegitimate as some top Democrats claim. The Constitution clearly spells out how Supreme Court justices are to be chosen and approved, and President Trump and Congress followed that rule. That makes this a legitimate court, regardless whether pro-abortionists like it or not.
This ruling does not mean that other decisions are in jeopardy. Nancy Pelosi and her ilk are lying that Friday’s decision jeopardizes other decisions, like same-sex marriage, contraception and even inter-racial marriage. The ruling made clear that this only refers to the abortion issue and not to any non-abortion decisions previously made by the Court.
Pro-lifers care about life after birth. One of the tropes of the left is that the pro-life movement only cares about babies in the womb and then offers nothing for the mothers and babies after birth. In fact, most of the post-birth care facilities in the country are run by pro-life groups. Pro-lifers are the biggest advocates for adoption. And they’re the biggest champions of strong families that create responsible adults.
Friday’s decision will likely have very little affect on the November mid-term elections. Most people foresee Republicans retaking the majority in both the Senate and the House of Representatives in November because of the many unpopular Democrat policies. After the Supreme Court’s ruling, some pundits on the left quickly averred this would energize the Democrats and swing the election their way. The truth is that the abortion issue is secondary for many voters compared to the economy, gas prices, taxes, etc. It might make a difference in some state elections, but even that is doubtful since this was already an issue for many local voters.
It's actually hard to find any of the arguments by the pro-abortionists that aren’t based on a lie, and often an obvious lie. Maybe the one that comes closest is that abortion takes the burden of motherhood off of women, but even that is iffy since many women – probably the majority of women – see motherhood as a blessing, not a burden.
